1. Parties and Scope

This document governs the terms between smrtpoll, the operator of the smrtpoll platform (the "Platform"), and the organizations ("Customer") and survey respondents ("Participants") that use it.

By using the Platform you agree to these terms.

2. Service Description

smrtpoll is a B2B SaaS platform that lets organizations run anonymous surveys with employees and stakeholders. Each response is stored with a session UUID only; no personal information is collected, stored, or shared with third parties.

3. Anonymity Guarantee

      Under no circumstances does smrtpoll link individual responses to the person who answered.
      No one — including the Customer's own admins — can answer the question "who said what?".
    

Single-use codes: smrtpoll does not know who used a code.
Shared codes: a fresh session UUID is generated for every participation.
Blockchain record: every response's HMAC-SHA256 digest is written to Solana — contains no identifying information.

4. Data Processing and GDPR Compliance

smrtpoll operates in line with the EU General Data Protection Regulation (Regulation (EU) 2016/679, "GDPR").

The core survey system does not process personal data of participants.
Sole exception: demographic questions the Customer chooses to add (e.g. role, tenure) — these are reported in aggregated form only and cannot be linked to an individual response.
Data deletion: upon Customer request, all response data is permanently deleted within 30 days.

4.1 Privacy Notice (GDPR Art. 13)

This privacy notice applies to organization administrators ("Users") who register an account on the Platform. No personal data is collected from survey participants.

International Transfers

Your data is not shared with third parties for marketing. Platform infrastructure (hosting, CDN, email delivery) may be located outside the EEA; where transfers occur, we rely on Standard Contractual Clauses (SCCs) as required by GDPR Art. 46.

Retention

Your account data is retained while your subscription is active. Upon account deletion, your data is permanently erased within 30 days.

Your Rights (GDPR Art. 15–22)

You may exercise the following rights with the Data Controller:

Right of access — confirm whether we process your data and obtain a copy
Right to rectification — correct inaccurate or incomplete data
Right to erasure ("right to be forgotten")
Right to restriction of processing
Right to data portability
Right to object to processing based on legitimate interest
Right not to be subject to a decision based solely on automated processing
Right to lodge a complaint with a supervisory authority in your country

5. Industry Benchmark Data NEW

      When sufficient participation is reached (at least 3 organizations and 30 respondents), smrtpoll may produce anonymous, aggregated industry benchmark data. This data may be used for research and product development.
    

What is published: Industry averages (e.g. "Education sector eNPS average 6.4").
What is not published: Organization-level data, individual responses, or any identifying information.
Opt-out: Any organization can opt out via account settings or by emailing [email protected]. The choice is applied immediately and is irrevocable.
Existing organizations: are included by default. Contribution continues unless opt-out is requested.

6. Subscription and Payment Terms

All plans are billed annually. Pricing is currently being finalized for the global launch.

Starter — small teams, up to 500 responses, 3 active surveys
Business — up to 2,500 responses, 10 active surveys
Enterprise — up to 8,000 responses, unlimited active surveys
Custom — by quote — unlimited responses, custom integrations

Once a plan's annual quota is reached, no further responses are accepted; you may upgrade to a higher tier at any time. Subscriptions cancel at the end of the next renewal cycle; refunds are not provided.

7. Acceptable Use

The following are prohibited:

Automated, systematic data collection (scraping)
Any attempt to de-anonymize responses
Stuffing surveys with fake respondents (response manipulation)
Sharing account credentials with third parties

8. Blockchain Record

When a response is saved, an HMAC-SHA256 digest of the session ID is written to the Solana blockchain. This record:

Makes tampering detectable (on-chain TX count ≠ report response count → intervention occurred).
Contains no personal information; the hash cannot be reversed.
Is permanent; it cannot be removed even on request.

9. Limitation of Liability

smrtpoll is not liable for indirect damages arising from platform downtime, data loss, or third-party infrastructure failures. Direct-damages liability is limited to the annual subscription fee paid.

10. Changes

This document may be updated without prior notice. Material changes will be notified by email to your registered address at least 30 days in advance.

smrtpoll uses the following cookies and local-storage mechanisms on smrtpoll.com and api.blokanket.net:

Strictly Necessary

Required for the site to function; cannot be disabled. No consent required (GDPR Art. 6(1)(b) — Contract performance).

uye_token (localStorage): Session management for logged-in users. Duration: until logout or browser clear.
smrtpoll_cookie_consent (localStorage): Your cookie preference. Duration: persistent until cleared.

Third-Party Cookies

Cloudflare (bot protection, performance): __cf_bm, cf_clearance, etc. Policy: cloudflare.com/privacypolicy

Analytics / Advertising

smrtpoll does not currently use Google Analytics, Facebook Pixel, or any third-party analytics/advertising tracking.

Managing Cookies

You can delete existing cookies and block new ones via your browser settings. Blocking strictly necessary cookies may prevent login and survey functionality.

On your first visit a "Cookie Preferences" banner appears at the bottom of the page. To reset your choice, clear the smrtpoll_cookie_consent entry in your browser's localStorage.
